Summary


The land and title specialist provides support and subject matter expertise to the project development team to produce clean and marketable title to allow for construction to commence. The land and title specialist will serve as a point of contact between third-party developers and NES as it pertains to curative title measures to move project acquisitions forward. The land and title specialist works directly with title insurance companies, lenders, and other financiers to obtain construction loan financing.

Job Responsibilities

  1. Work within the Project Development team to order and review real estate documents such as deeds, title reports/commitments, legal descriptions, ALTA Surveys, etc.
  2. Deeds, title commitments, and ALTAs need to be updated by close of business the day prior to closing on a construction loan, MIPA closing and/or any other project financing closing to keep projects on track for financing and construction. If the deadline is unable to be met, this must be communicated in advance to Sr. Land and Title Specialist.
  3. Collaborate with Business Development team to review and vet potential sites for project acquisition.
  4. Coordinate with third-party developers for project acquisitions, lenders, internal and outside counsel to close on project loan financing. Meet deadlines as set forth by business development to prepare title opinions for project acquisitions and Membership Interest Purchase Acquisitions (MIPAs) to continue schedule.
  5. Provide title opinions on title reports/commitments and make determinations on curative title work to be completed prior to closing on third-party project acquisition closing dates.
  6. Prepare title opinions on assigned projects to company’s title tracker template and post to internal software prior to projects moving into the Facility Impact Study (FIS) in the project queue.
  7. Manage title search companies to produce title reports/commitments, identify and resolve issues to produce clean titles to allow for construction financing closing date to occur and construction to stay on schedule. This includes removing of Exceptions on title commitments including, but not limited to: Obtaining SNDAs or mortgages releases; Removing Liens; Gain crossing over existing easements, Right of Way; Mineral rights agreements, affidavits, and others, etc.; Recording of documents.
  8. Coordinate with utility companies regarding design requirements needed that may require easement acquisition.
  9. Settle construction damages, as needed, with landowners, tenants and/or designated representatives.
  10. Prepare, review, and edit land agreements for execution.
  11. Assist members of the Project Development team as needed, to move projects along in development phase.
  12. Collaborate with Novel Land Sales and Business Development team members to interact with landowners to execute site property documents and discuss and resolve land development concerns.
  13. File, in paper and electronically, all Property Documents
  14. Communicate with Project Development Vice President, Senior Land and Title Specialist, and others as needed, to provide clear understanding of land issues, as well as land issues and needs that may impact permitting and Utility Interconnection.
  15. Communicate weekly during the Land and Title team meeting on status of assigned projects and inform Sr. Land/Title Specialist of any matters that need to be addressed to keep financing and construction schedules on track.

This job generally operates in a professional office environment and in the field. This role routinely uses standard office equipment such as computers, phones, photocopiers, filing cabinets and fax machines.?The employee is occasionally exposed to a variety of extreme conditions at job sites

This position occasionally requires long hours and occasional weekend work.

Required Education and Experience

  • Two years of post-secondary training.
  • 3-5 years combined experience in real estate or right of way
  • Valid driver’s license

Preferred Education and Experience

  • Minnesota Real Estate License
  • Minnesota Notary Public
  • American Land/Title Association professional development training
  • Bachelor’s degree in relevant field
